Rough Collie Spay/Neuter Sales Agreement

This agreement is made and entered into this               day of                            20       by and between Saddleback Kennels,

Daniel Luce, Jr., and/or Cecilia E. Luce (seller), and _____________________________(buyer), for the purpose of

setting forth the terms and conditions of purchase by the Buyer of an Purebred Rough Collie puppy from the litter whelped

on __________________out of ____________________________________ and ______________________________.

For $                          , the Seller agrees to sell and the Buyer agrees to purchase a female              , male              companion puppy/dog from the litter described above subject to the following terms and conditions.

1.        The above-described puppy/dog is sold as a pet and family companion and will not be used for breeding purposes.

          Buyer agrees the above-described puppy/dog will be spayed/neutered within 7 months of purchase. 

2.           Seller warrants that the above-described puppy is a Purebred Rough Collie registed with the American Kennel

         Club (AKC) and that registration papers will be provided to the Buyer. The buyer agrees to spay or neuter the

         puppy at the age deemed appropriate by their vet. Evidence from a licensed veterinarian that the puppy/dog has

         been spayed/neutered may be requested . 

3.            Seller warrants that the above-described puppy is in good health and has received age appropriate vaccination(s)

         and worming(s) at the time Buyer assumes ownership. Buyer agrees to have puppy examined by a licensed

         veterinarian within two (2) days (not including weekends and holidays) of receipt of puppy. 

If, as a result of the examination, the veterinarian determines that the puppy is not in good health then the Buyer shall elect to keep the puppy or return the puppy to the Seller for a refund. If the Buyer elects to return the puppy, Buyer shall, immediately fax to Seller at _________________ a written veterinarian’s certificate stating that the puppy was in ill health when examined. Upon receipt by Seller of said certificate, Buyer shall be obligated to return the puppy to Seller at Buyer’s expense. Upon receipt of the puppy, the Seller shall be obligated to refund all monies received from Buyer toward the purchase price of the puppy, and further performance under this agreement shall be null and void. Buyer shall personally return the puppy to seller via private automobile or by plane as carry on by the buyer or his agent.

 4.           Seller warrants that if the puppy develops hip dysplasia within 25 months from the date of birth, Buyer may return the

          puppy to Seller and will receive a replacement puppy of like quality from the next available litter, or may choose to

          keep the puppy. If Buyer elects to keep the puppy, Seller will refund one half of the purchase price upon receipt of

          evidence from Orthopedic Foundation for Animals (OFA) via certified mail proving the dog does indeed have HD. 

If Buyer chooses a replacement puppy, Buyer and Seller shall make prompt arrangements within 10 days of receipt

of certified letter and OFA findings for return of the puppy sold herein to Seller’s place of business. Buyer shall be responsible for taking good and reasonable care of the puppy until Seller receives it. Costs and related expenses

of returning the puppy to Seller shall be the obligation of the Buyer.

 5.         Seller warrants that the above-described puppy will be free from any congenital or hereditary abnormalities that

         would prevent it from being a good pet and companion for a period of one (1) year. If the puppy is deemed

         unsuitable for reasons described above, evidence from a licensed veterinarian will be sent to Seller via certified

         mail. Buyer may elect to return the puppy to Seller (at Buyer’s expense) and receive a replacement puppy from the

         next available litter, or receive a refund of the sale price. If it is the opinion of a licensed Veterinarian that the puppy

         should be euthanized, Buyer will return the puppy to Daniel and/or Cecilia Luce so that they may have their own vet

         do the euthanasia at their  expense. Buyer will receive refund of purchase price upon return of the dog to

         Saddleback Kennels, Lafayette, Indiana. 

6.           Seller warrants that the above-described puppy/dog will have a gentle disposition for the remainder of his/her life. 

         If evidence of aggressive behavior is observed and it is the opinion of two (2) licensed veterinarians that the behavior

         is not caused by a medical condition, neglect, or abuse by any person or animal, the Buyer agrees that puppy/dog

         will be euthanized. The Seller will replace the puppy/dog, or refund the sale price upon receipt of evidence of

         aggression and euthanasia by a licensed Veterinarian.  If buyer chooses to have a replacement puppy but the seller

         prefers to refund the money instead, it shall be the seller’s choice of options. In case of aggressive behavior, the

         buyer has choice of having his/her vet do the euthanasia at buyers expense or returning the dog to Saddleback

         Kennels at buyers’ expense. Daniel and/or Cecilia Luce will then have their vet do the Euthanasia at their expense. 

7.           Buyer agrees that if situation should ever arise in which buyer can no longer offer this dog a home (can no longer

         keep the dog) the Buyer will notify the Seller. Buyer agrees not to turn dog over to any rescue group but to return the

         dog to seller and seller will find a home for the dog; return of dog to seller shall be at buyers expense. All further

         expenses incurred in finding a new home for the dog shall be that of the seller to pay. No “rescue fees” shall be

         charged the buyer by the seller in regard to finding the dog a new home. If the buyer locates a suitable home for

         the dog prior to return of the dog to Saddleback Kennels, Lafayette, Indiana, then the buyer and Daniel and/or

         Cecilia Luce will discuss said home and decide together if it is appropriate for the dog or not.

Buyer agrees that the puppy will reside IN the home of the Buyer, AND MUST BE PART OF BUYERS FAMILY. Dog

shall have access to a fenced yard, not be chained or tethered, and will be provided with a good quality diet, annual

shots and any other related health care.  Buyer also agrees that this puppy/dog will not be used as a guard dog for

any business. Buyer agrees that at least one basic obedience training course will be completed with the puppy/dog

(or equivalent training in home by a qualified person or persons) with as many members of the buyer’s family as possible.

This puppy is purchased, taken delivery of and paid for in full at Saddleback Kennels, Lafayette, Indiana.

This Agreement is made and signed by both parties to insure the well-being and protection of this puppy/dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligations under this Agreement.  This agreement

took place on _________________________ at Saddleback Kennels in Tippecanoe County, Indiana.
